In a public hearing vaguely reminiscent of one that discussed the Department's proposed broker fiduciary regulations, the California workers' comp industry, among others, questioned the Department's authority to even promulgate reinsurance regulations, never mind the arbitrary nature of the proposed regs. It remains to be seen if testimony submitted by the major trade associations and the Reinsurance Association of America will be able to convince the Department to reconsider its approach.
