It is rumored that defendants in en banc decisions on when California's new permanent disability rating schedule applies are considering filing a petition for reconsideration. This comes as speculation runs rife on whom Joseph Miller, chairman of the Workers' Compensation Appeals Board, will assign to be the seventh commissioner to possibly hear the case. At stake are potentially tens of millions of dollars in benefit payments for the industry and self-insured employers.
