WCAB En Banc Decisions Remain Binding Precedent on All WCAB Panels and WCJs Until Overruled, Stayed or Suspended

In this recent Significant Panel Decision, WCAB took the position that its en banc decisions are more durable precedent than an opinion by the Court of Appeal. A Court of Appeal opinion becomes uncitable as authority when the Supreme Court grants review. But, according to WCAB, its en banc decisions continue to be binding precedent on all WCAB panels and WCJs even when the Court of Appeal grants review, and remain so until expressly overruled, stayed or suspended by the Court of Appeal.
